Paul McNutt had his arraignment in Taylor county court today, January 9th, shortly after 9am. McNutt was not present, but his attorney Ryan Peters was there on his behalf. Peters says the reason for pleading not guilty is self defense.

UPDATE Jan. 5, 2012 - Perry, Florida -

A Perry man accused of murdering a father and son has pleaded not guilty.

The Taylor County Clerk's office says Paul McNutt entered the written plea on December twelfth. McNutt was arrested last month. He's accused of shooting and killing Lee Spees Junior and Senior ... as well as injuring David Spees. Deputies say the gunfire stemmed from an ongoing argument the men had over some land.

McNutt is schedule to be arraigned in court on Monday.

The arraignment for Paul McNutt is scheduled for January 9th at 9am at the Taylor County Courthouse.

UPDATE December 14, 2011 6:30 p.m.

Two Perry families involved in a dispute that turned deadly, have filed restraining orders against each other.

A Taylor County judge will hear arguments for the restraining orders Thursday.

Deputies say Paul McNutt shot three members of the Spees family last last week, leaving two of them dead.

If approved, the restraining orders will prevent both the Spees and McNutts from going within 500 feet of each others homes. It will also prevent the Spees from going to Diane McNutt's work and church.

According court documents, the Spees filed theirs within days after the shooting. The court documents show the McNutts filed theirs the following week.

The quiet community of Perry is still mourning Monday's deadly shooting of a father and son.They are set to be buried tomorrow.

Neighbors tell us this deadly shooting was the result of a feud over an easement. Trey Howard represents the Spees Family in that civil suit. He says this tragedy has just left the family devastated.

"You don't believe it at first. You never believe truly horrific things that you hear, but as the day went out, just an unbelievable situation. "

Trey Howard has known the Spees for several years, acting as the family's civil attorney. The three men he represents, Lee Senior, Lee Junior and David were shot Monday in Perry. Senior and Junior died from their injuries while David remains in the hospital.

Deputies say the shooting stemmed from a dispute over land between the Spees and Paul McNutt, the alleged shooter. McNutt has since been charged with two counts of murder and one count of attempted murder.

"They're just devastated. They've lost a father, a brother, a dad. They need to be in everyone's thoughts and prayers right now," says Howard.

The Spees moved from Michigan to Perry in the 80s. Howard says they are good, hard-working folks, especially the father.

"He was just crafty. Anything he put his mind to do, he could do," Howard says.

But what Howard says he'll miss the most is seeing the men around town.

"If you need to call somebody and find out, you can't call them anymore. You can't see them, you don't see them at Gray's eating hamburgers. It's just an awful situation," says Howard.

A viewing is scheduled tonight at the New Home Baptist Church for both Lee Spees Senior and Junior. Their funerals will be tomorrow at 11 a.m. David Spees is in serious condition at Tallahassee Memorial Hospital.

The condition of the lone survivor from Monday's deadly shooting in Perry has worsen.

David Spees' condition was downgraded from fair to serious condition Friday, according to a spokeswoman at Tallahassee Memorial Hospital.

Deputies say Spees and his father and brother were shot by Paul McNutt because of an ongoing disagreement over land.

McNutt has been charged with two counts of murder and one count of attempted murder. He is being held at the Taylor County Jail.

The Taylor County Sheriff's Office has released the probable cause affidavit for Monday's deadly shooting, which says a video tape of the shooting may exist.

According to the affidavit, the shooting resulted from an ongoing disagreement between the Spees and McNutt over a land easement.

The affidavit says Daine McNutt told deputies Lee Spees Sr, Lee Spees Jr. and David Spees were taking down a temporary fence that McNutt had put up to prevent the Spees from driving bulldozers and equipment across the road and damaging it. The affidavit goes on to say Diane says she was threatened by the Spees and told her husband Paul McNutt, who was standing next to her, to call the police because they were threatening to kill her. Diane tells investigators she did not see her husband go into the home, but she did see him a few minutes later with a shotgun. The affidavit says Diane told investigators she saw her husband shoot the Spees.

According to the affidavit, Paul McNutt told investigators he remembers his wife saying help, but does not recall the shooting.

Deputies say a 12 gauge Remington 870 pump shotgun and a 9mm Glock handgun were found on the easement, about 15-feet from where Lee Sr.'s body was found. In that same area, deputies say they also found eight, spent, 9mm cartridge cases and one live 9mm cartridge case.

The affidavit goes on to say Connie Spees told investigators that she also witnessed Paul McNutt shoot all three victims and had captured the incident on video tape.

A civil case regarding that land easement was scheduled to be heard in January, but according to the Spees' attorney, Trey Howard, that has been postponed.

David Spees, the lone survivor of the shooting, is listed in fair condition at Tallahassee Memorial Hospital. He is scheduled to undergo surgery on Friday, according to Howard.

A viewing is scheduled for the Spees on Friday from 5-8 p.m. at the New Home Baptist Church in Perry. The funeral will be Saturday at the church at 11 a.m.

McNutt's a made first appearance on Wednesday, where his attorney, Ryan Peters, says McNutt suffered a medical seizure. Peters says McNutt has recovered and is back in custody at the Taylor County Jail.

Monday's deadly triple-shooting has left residents of this normally quiet Perry neighborhood shocked.

"It blew my mind really. It was just awful," says Michael Walker.

The Taylor County Sheriff's office says 69-year-old Paul McNutt shot Lee Spees and his two sons, Lee Spees Jr. and David Spees
near Johnson Stripling Road around 5:30 Monday night. All three men where taken to the hospital where Spees Jr. was pronounced dead. Spees Sr. past away the following day.

"It's just unfortunate that people's lives have to end at the hand of others for anything. It's just very unfortunate," says Captain Ron Rice of the Taylor County Sheriff's Office.

Neighbors say Spees Sr. moved from Michigan during the mid-80s and describe him as a well-liked handyman.

"He really enjoyed the crafts. He really enjoyed working on things. That was his love. That was his hobby," says Walker.

The Sheriff's office isn't releasing a motive for the shooting at this time, but neighbors say it stems from a disagreement between the Spees and McNutt over an easement.

"I never really would have seen him as that kind of guy, you know? Good family. I just never really thought it was that bad," says Walker.

McNutt is being held without bond at the Taylor County Jail while David Spees remains in fair condition at Tallahassee Memorial Hospital.

There are now two people dead in a feud that ended in gunfire Monday.

Captain Ron Rice with the Taylor County Sheriff's Office says Lee Edward Spees Sr. died last night from the wounds he received in that shooting.

Charges against the suspect in this case, Paul Eugene McNutt, have been upgraded to two counts of murder and one count of attempted murder.

The surviving victim, 42 year old David Spees, remains in Tallahassee Memorial Hospital. TMH lists his condition as stable.

Yesterday (Monday 5 December 2011) at approximately 5:30 pm a call was received in reference to a shooting incident in the 3000 block of Johnson Stripling Road. Multiple Sheriff’s Office Units responded to the scene. Three victims were located with gunshot wounds. Also at that time a person, who was determined to have been the shooter, was taken into custody. The three injured people are Lee Edward Spees (age 70), Lee Edward Spees Jr., (age 48) and David M. Spees (age 42). They were all transported to Doctor’s Memorial Hospital in Perry, Florida and then transferred to Tallahassee Memorial Hospital were Lee Spees Jr., later died from his wounds. The other two victims remain in Tallahassee Memorial Hospital. The person taken into custody was Paul Eugene McNutt (age 69). Mr. McNutt was charged with one count of murder and two counts of attempted murder and is presently being held in the Taylor County Jail with no bond.

The Taylor County Sheriff’s Office is currently investigating the crime along with the Florida Department of Law Enforcement. If anyone has any information you may call 850-838-3505.

Deputies in Taylor County are trying to sort out an incident that left one person dead and two people critically injured. Gunshots rang out last night at about 5:30pm on December 5th.

Lee Edward Spees Jr. is dead after a shooting in Taylor County. Two other adults are critically injured. Paul McNutt was arrested on one count of murder and two counts of attempted murder.

UPDATE 12-5-2011

Three people were shot in Taylor County. It all happened on Johnson Stripling Road.

Captain Ron Rice, chief investigator for Taylor County Sheriff's Office, says, "Well, we are conducting an investigation at this time, we've not complete it, FDLE is on the scene and they are going to assist us with the investigation and we'll see where it leads."

Dennis Cannon, a nearby resident, says, "It's very disturbing to have something this close to your house you know happen."

Very few details surrounding the incident have been released at this time, but we will you bring any updates as they become available.

Taylor County, FL -- December 5, 2011 --

Taylor County Sheriff's Office chief investigator, Captain Ron Rice says three people have been shot and were taken to different hospitals.

A suspect is in custody. Rice wouldn't say if there were more suspects but said the investigation is on going. They are working on a motive.

WCTV has a crew on the scene and is trying to gather more information. A family member who lives down the street declined to comment on what is happening.
