Circuit Judge Nikki Ann Clark refused to try the lawsuit before Election Day, saying she was concerned about giving elections officials and the slots campaign enough time to prepare their defense to a complex and serious case.
But Clark pointed to the lawsuit itself, which asked for a post-election solution if necessary. She says that indicates there does not need to be a “rush to judgment” before November 2.
If approved by voters, the proposed amendment to the state constitution would let voters in south Florida decide in a future election whether to allow slot machines at seven horse and dog tracks and jai alai frontons.
