Teen Curfew Laws

The Florida Supreme Court is considering whether teen curfews are constitutional.

Tuesday, attorneys argued before the court on behalf of several teens in Tampa and Pinellas Park who were cited for breaking juvenile curfew ordinances.

Already, an appeals court has ruled the curfews are unconstitutional and attorneys at Wednesday's hearing believe the high court will agree.

"I think the juvenile curfew ordinance is unconstitutional. There is no compelling reason why we should have juvenile curfew ordinances and the means that were used are so draconian, they certainly cannot pass constitutional muster,” attorney Bruce Howie comments.

Largo, Miami Dade County and Orlando also have juvenile curfews, although Orlando’s is not citywide. The justices' decision could have an impact on those ordinances.
