A man accused of one of Tallahassee's most heinous murders is appealing his death sentence again.
Joe Elton Nixon is accused of abducting Jeannie Bickner from the Governor's Square Mall parking lot back in 1984, tying her to a tree and setting her on fire.
Tuesday, Nixon's attorneys argued that he is mentally retarded and thus ineligible for execution. A hearing on that claim is now set for October in Leon Circuit Court.
