Travis Peacock Appears in Court
A Havana man indicted on first degree murder for the death of his girlfriend appeared in court Monday. Now he'll soon be transferred to a mental illness facility that could eventually prove him competent to stand trial.

More than five years after Sevetra Donaldson was shot multiple times in her home allegedly by her high school sweetheart, Travis Peacock.

Her family's wounds were reopened Monday.

"It's a step in the right direction, it's a step. it's the beginning," says Sevetra's Mom, Patricia Jefferson.

The State wanted Peacock to be transferred from Pathways at Sunland to Florida State Hospital where he would restart his competency training, a 2 year process.

But, the defense says Peacock's mental illness was very well documented prior to his offense, proving that he was and still is incompetent to stand trial.

The state doesn't question his mental retardation, but says he has been malingering or over exaggerating his mental illness.

"His malingering has allowed him to generate inaccurate evaluations of his competency," says state prosecutor Jack Campbell.

And the victim's family wants justice.

"It was devastating, for someone to try and beat the system by saying he was insane or something like that. That's not right," says the victim's Dad, Jimmie Lee Donaldson.

A grand jury indicted Peacock on first degree murder charges in December of 2004.

When the judge found him incompetent to stand trial, Peacock was transferred to Florida State Hospital, the same place where Sevetra's Mom has worked for the past seven years.

She says he would taunt her with gestures on a regular basis, a heartbreaking reminder of what happened to her daughter.

After more than three years, Peacock was transferred to Pathways at Sunland, but as of Monday, he's back where he began.

Administration says they will make great strides to make sure that their paths don't cross on the facility's grounds.

He's being transferred back to Florida State Hospital because it's the only mental facility in Florida that provides competency training.

Additional Facts:
As for the victim's daughter who was found crying around her Mother's body when police arrived is now 7-years-old.

Family say although she asks about her Mom from time to time, she's doing just fine.

An update on Peacock's progress will be submitted to Judge Terry Lewis in 6 months.

There's nothing wrong with him,he just don't want to be sent to regular prison!! He is just acting crazy!!A Real convict in Prison will show him who's crazy!!

I DON'T THINK ANYTHING IS WRONG WITH HIM HE MADE HIS CHOICE TO TAKE HER LIFE SO THERE FOR HE SHOULD PAY FOR IT YOU DO THE CRIME EXPECT TO DO THE TIME
