[Update] - Valdosta, Ga. - Feb. 08, 2012 -

The former president and chief executive officer of Archbold Medical Center is denied a new trial.
Ken Beverly petitioned the court based on several assertions that the court abused its discretion, including in throwing out polygraph test results.
But the court ruled that there is overwhelming direct and circumstantial evidence in support of the jury's guilty verdict.
Beverly was found guilty of six counts in Valdosta U.S. District Court in December 2010.

On April 8th, a federal grand jury indicted Ken Beverly on six counts of fraud.

He's accused of falsifying and submitting fraudulent documents to the Georgia Department of Community Health to get nine-million-dollars in Medicaid money.

Beverly worked at Archbold for more than 30 years until he retired in 2008.

Beverly's trial was scheduled to begin Monday, November 29 but it was postponed until all jurors are selected.
