Heller's attorney says they deny the charges and are investigating. "We are grateful Mr. Thomas was released from the hospital and is recovering," defense attorney Tim Jansen said.

A Florida State University spokeswoman says state and federal law prohbits her from commenting on Heller's status at the university.

"The Dean of Students Department is working closely with law enforcement in this case and is taking steps as appropriate to ensure the continued safety and security of our community," said University Communications Director Dr. Jeanette DeDiemar. "In addition, the Dean of Students' Victim's Advocate Program has been working with the victim to provide any assistance he may need."

DeDiemar said in this case and every case, FSU's Office of Student Rights and Repsonsibilities will review a police report for possible violations of the student conduct code and then take appropriate action.
