A judge has dismissed a criminal case against a Tallahassee bar owner, who was charged with a misdemeanor for playing loud music.
Matthew Foster represents the owner of AJ's Sports Bar on West Tennesee Street.
Despite obtaining a permit to play live music, the owner was charged with disorderly conduct and breach of peace after neighbors complained about the noise.
This week, a judge ruled those charges unconstitutional.
That statue is not designed to be a noise ordinance. It's only designed to prohibit and criminalize conduct or speech that rises above the level of inticing a riot or creating immediate threat or danger."
Foster says his client is willing to work with neighbors, as long as there are reasonable guidelines in place.
