Family of Man Struck, Killed By StarMetro Bus Files Suit

The family of a man run over by a StarMetro bus is now suing the city.

The family of 64 year old James Richard Tomlinson has filed a wrongful death suit against the City of Tallahassee.

Tomlinson died in October 2013 as he tried to catch a Star Metro bus on Pat Thomas Boulevard.

According to court records, the family claims the bus driver was negligent in pulling away when Tomlinson was just inches from the door. The suit claims Tomlinson was run over and killed by the bus's rear wheels.

Tallahassee FL- Police have now identified the man who died after trying to chase a Star Metro Bus in Tallahassee.

64 year old James Richard Tomlinson was run over by a Star Metro Bus yesterday afternoon. According to the Tallahassee Police Department, Tomlinson was running along the right side of the bus, in what they believe to be an attempt at getting the drivers attention. TPD says they are currently investigating.

Tallahassee Police Department's Officer David Northway explained, "At this time we are only investigating it as a traffic crash or an accident and there are no pending charges at this point. But again any piece of evidence could start to show something-- a witness could come forward and say to us 'this is what I say' and that may change the direction of the investigation."

The bus driver has not been suspended and StarMetro doesn't have any plans to suspend them at this time. However, we have been told the bus driver is not back on the roads today because they are receiving counseling regarding the crash.

TPD Traffic Homicide Investigators have identified the pedestrian from this traffic crash.

Tallahassee, FL - The 911 calls started pouring in at about 12:25 this afternoon. Tallahassee Police say the StarMetro Bus was southbound on Pat Thomas Boulevard when a pedestrian began running along the side of the bus, presumably trying to get the drivers attention.

Police say the pedestrian was run over by the bus's rear wheels.

Police have not yet released any information about the person who died. They're trying to reach the family.

Today at approximately 12:25pm, Patrol officers for the Tallahassee Police Department were called to a traffic crash involving a StarMetro bus and a pedestrian, after receiving multiple 911 calls about the accident. Leon County EMS and TFD also responded and treated the victim on scene before transporting him to a local hospital where he succumbed to his injuries.

Investigators with TPD’s Traffic Homicide Unit were called to the scene to review the evidence. Preliminary investigation has revealed the StarMetro Bus was southbound on Pat Thomas Boulevard when a pedestrian began running along the right side of the bus, presumably trying to get the drivers attention. The on-going investigation has shown the pedestrian was run over by the rear wheels as the vehicle drove along its route.

The name of the deceased is being withheld at this time, pending notification to the family.
