Texting & Driving Ban Among New Florida Laws

Tallahassee, FL - More than two dozen laws passed by Florida legislators are scheduled to kick in Tuesday, October 1st.

Among them, is the much talked about, or texted about, ban on texting while driving.

Florida's new texting law says that you can still text or email when you're stopped at a red light. However, texting or emailing while you're driving is what's going to be illegal.

The Sunshine State is the 41st state to ban texting or emailing while driving.

Tallahassee resident Melissa Denis says, "I grew up in Georgia where the law was already enacted. I think it's a smart law because a lot of people get in accidents for texting and driving. I've noticed people even myself, if you check your phone, all of a sudden you realize wow, I didn't look at the road at all. So, I think it'll be smarter."

The new law is a secondary offense, meaning officers have to stop you for something else first.

The first violation is a $30 fine. Every texting ticket after that counts as a moving violation, so it can add points to your drivers license.


TALLAHASSSEE, Fla. (AP) -- It's becoming illegal to text and drive in the state of Florida.

State legislators this spring passed the texting while driving ban but it does not take effect until Tuesday.

The ban is one of more than two dozen laws passed by state legislators scheduled to kick in.

Other new laws taking effect include one that guarantees the public a right to speak at meetings being held by city and county governments.

Another new law bans welfare recipients from using electronic benefit transfer or EBT cards at "adult entertainment establishments" such as strip clubs and casinos.

Florida is joining 40 other states with a ban on texting while driving.

The law makes it a secondary offense which means police have to first stop drivers for another offense.
