[UPDATE] Former FSU Defensive Back Enters Plea

Former FSU cornerback Avis Commack will spend 30 days in jail for stealing an Ipad.

Commack must report to jail by 5pm today.

Commack entered a no contest plea today to misdemeanor charges of petit theft. He was also ordered to pay $40 to replace a computer cover that he threw into a dumpster behind the University Center.

Commack still contends he did not steal the ipad but found it in the stairwell.

"This is a plea of convenience," said Commack's attorney Tim Jansen. "He took this plea solely so he can resolve this and report to the University of Akron in May to take advantage of a football scholarship."

Commack was arrested in December 2011 and accused of stealing a 600 dollar i-pad. The i-pad disappeared from a computer lab in building D. FSU police say Commack logged on with his own user name three days later from the lounge outside the football locker room.

"It looked like all the data in the computer, in the i-pad had been wiped. Any pictures, any documents, any bookmarks and that sort of stuff had been removed from the computer," FSU Police Jim Russell said at the time.

Commack told police he found the i-pad in a stairwell and admitted to throwing away its flowery cover in the dumpster out back. All are indications, police said, that Commack had no intention of returning it.

FSU junior cornerback Avis Commack was arrested for grand theft earlier this week. He's accused of stealing a student's Ipad.

Commack was released on Friday afternoon.

Commack is no longer practicing with the team. It's Florida State's policy that if a player is being charged or arrested, even if he hasn't been convicted, he cannot represent the university until the legal process has taken its course.

FSU Head Football Coach Jimbo Fisher had no comment on the matter.

Police say Commack told them he found the Ipad in a stairwell. Instead of turning it in, he held on to it.

The Jacksonville native played in 11 games for the Seminoles this season, recording eight tackles.

Commack is not practicing with the team. FSU's policy is that if a player is being charged or arrested for something, even if he hasn't been convicted, he cannot represent the university until the legal process has taken its course. Commack is alleged to have stolen an Ipad from an FSU student in early December. Coach Fisher said he didn't have anything to comment on the matter until the case is resolved.

Apparently Commack told police he found the Ipad in a stairwell, took it and held onto it figuring that someone lost it. Instead of turning it in, he decided to keep it.

Florida State Cornerback, Avis Commack was arrested on Friday, December 16th. Warchant.com says Commack was taken in for allegedly stealing an I-pad. The red-shirt Junior defensive back was found after police say he'd logged into the campus's network using his student identification. After that a warrant was issued for Commack. When authorities found him he handed over the I-pad and said he found it. Commack is being charged with one count of grand theft.
