You are 100% correct. The scenario you describe is exactly why the legislature passed the SYG law in the first place. People who are guilty of nothing other than defending their own, or their family members lives, are financially bankrupted, their lives destroyed, and are publicly demonized, all at the whim of the arresting officer or prosecutor, who may or may not be having a bad day. You are also correct in thinking our lawmakers have absolutely no knowledge of the law. This is becoming more and more evident everyday, not only in this case, but in everything they comment on, or are involved in.

I have an issue with the proposed change "to let law enforcement officers detain those who claim the law as a defense while an investigation is conducted." So if you are a victim and are forced to shoot someone to protect yourself or your family, you become a victim again by getting jailed during an investigation that could take months to complete. In the meantime, you are taken from your family and will likely have lost your job or used all of your leave time. Nevermind the idea that a victim could end up with an arrest record to follow them the rest of their lives. And just what charge are you going to hold them on? Has Smith heard of the Constitution? I'm beginning to think our lawmakers have absolutely no knowledge of the law. It doesn't matter if they're Democrats or Republicans, stupid is stupid.

You are so right about that! The blacks don't like the law because it gets in the way of their robbing, assaulting, etc. white people. Got to make sure those black thugs don't get shot by white people trying to defend themselves!!

I'm a democrat and I don't stand with the democrats you are referring to. I fully support the " STAND YOUR GROUND LAW".If we could get rid of the republican corporate catering governor that we're apparently stuck with for the time being, Florida would have a chance to come out of the depression the he and his predacessors put us in. And no I did not miss spell predacessors, I spelled it the way I intended it to read!

These "recommendations" show that these people either don't understand the whole concept of self-defense, or are so anti-self-defense that they want crime victims to just lie down and take it. For example, they suggested requiring that you actually BE in imminent danger before using force, rather than simply believe that you are. This would make Florida's self-defense laws stricter than those of any other state, by far, and totally unrealistic. The reason why no state has such a standard is clear. What if a criminal points a gun at you and threatens to shoot you and your family? Are you in imminent danger? Should you be justified in using force to defend yourself and your children in that case? Before you say yes, consider that the gun might not be loaded, or might not even be real. If either of those two were the case, you would be guilty of a crime if you used force under Smith's idea of what the law should be. His version would require to actually KNOW that the gun was both real and loaded before you could defend yourself, not just reasonably believe that it was. That's obviously an idiotically unrealistic standard, but it's the one he's proposed (along with a bunch of other moronic stuff). That's why every single self-defense law in the US, including SYG in Florida, has the standard set instead so that you may use force if and only if you reasonably believe you're in imminent danger. Also, SYG is not new. It has been the standard for self-defense in the vast majority of the US since the country has existed. There are over a dozen state and federal supreme court rulings that have all consistently upheld SYG as the standard under which self-defense is determined, going back to almost the founding of the country. The most significant of these is Brown v. US. Florida was one of only 6 states that hasn't always had SYG as either a statute or as case law. It's SYG law just brought it up to the same standard that almost every other state has always had.

Start teaching our youth about MORALS and standard. Stop allowing people to act like thugs and giving fame to those who break the law.I will stand my ground! I will defend my property and my country!Stop sugar coating everything and be honest with people. If you have an individual that looks like a criminal and acts disrespectful in public and if we chooses NOT to correct the problem then we're asking for a bunch of fools running around causing trouble for the moral people.We turned our backs on being moral to be politically correct.Which has spawned a generation of fools and criminals.I challenge America to correct it's youth. This generation that is running the country now will go down as failures NOT hero's.Our Grandfathers fought to keep us free and safe and you've let it all go. For what? For money? For politically correctness? For a scam? Or because you just didn't care? United we stand divided we fall!!!

No special session is needed to waste more money, especially over one case. Why haven't you called for special sessions or investigations to one of the daily shootings that are taking place in Tallahassee. Sorry a kid died, but bad things happen sometimes.Let the courts decide not some panel the GOV selected or legislatures. You create laws, Police enforce them and the Judges Rule over these issues. Sorry you can't have it your way everyday, This is not Burger King! We have a system in place. Next session if you can muster up the votes, then ammend the law, but do not try to abolish it, as we all have a right to stand our ground. Oh yeah, don't even bother running for Senate again.
