Tallahassee, FL (AP) - A divorced spouse who contributed to
mortgage payments and other expenses of a house owned by his or her former mate is entitled to a share of any increase in the home's
value while they were married.
That's what the Florida Supreme Court decided Thursday in a
Hillsborough County case.
The justices unanimously reversed two lower courts that had
denied Katherine Kaaa a share of the amount the home owned by her
former husband, Joseph Kaaa, had increased in value due to
inflation or market conditions.
The opinion includes step-by-step guidelines on how judges
should determine awards for appreciation in such cases.
