(UPDATE) Accused Kidnapper in Court

A man accused of beating his girlfriend and then kidnapping her child has been deemed competent to stand trial.

22 year old Herley Davis was in court this week. Court records show a judge found him competent and moved him from mental health court to trial court to face those charges.

Police say on August 18th Davis got into a domestic dispute with his girlfriend in Tallahassee and wound up stealing her car and her one year old daughter.

The pair was spotted in at a Cracker Barrell in Lake City the next morning after an Ambert Alert was issued for Davis and the baby.

Tallahassee, FL - The judge in the case asked Davis' attorney if his client had a history of mental illness. His attorney said no, but she believes he does suffer from mental issues, and that's when the attorney asked to reschedule the hearing.
Police say on the night of August 18th, Herley Davis, 22, got in a domestic dispute with his girlfriend in Tallahassee. That's when Davis snatched Shantracia Tucker's one year old daughter, Naveah, and took off with the child in Tucker's car. An Amber Alert was issued and police caught up with Davis at a Cracker Barrel restaurant in Lake City the next morning.
A quick thinking restaurant employee had seen the two and called 911.
The judge rescheduled Davis' mental health hearing for October 26th.
