Florida Justices Rule Court Fees Constitutional

The Florida Supreme Court has approved
the diversion of a portion of civil filing fees from a court system
trust fund to the state's general purpose fund.

The justices Thursday unanimously reversed a Tallahassee circuit
judge who had ruled that practice makes the fees an
unconstitutional tax.

Justice Ricky Polston wrote for the high court that the fund
shift meets constitutional muster because the Legislature can -- and
does -- appropriate more money from the general fund than it take in
from court fees.
