TAMPA, Florida -- July 7, 2012

Authorities say the man struck by a drunk driver while sitting at a bus stop bench in Tampa has died.

The Hillsborough County Sheriff's Office says 49-year-old Daryl Smith died Friday as a result of his injuries.

According to deputies, 25-year-old Manuel Mendez-Hernandez swerved a 2003 Chevrolet van off the road on Tuesday and struck a bench where Smith was sitting.

Investigators say Mendez-Hernandez fled the scene but was later caught and apprehended. Charges against the Tampa man were upgraded on Friday to DUI manslaughter.
