Former FSU Student Found Guilty of DUI Manslaughter

Keith Schmalz is accused of DUI manslaughter in the death of his longtime friend, Sevag Davidian.

Keith said, "I have no recollection at all of the accident or the night in question."

Keith Schmalz took the stand and testified in his own defense, answering questions about what happened that August night when his SUV went airborne and crashed into six parked cars on the FSU campus.

His friend Sevag Davidian was thrown from the SUV and killed, but Schmalz told the jury he doesn't remember the crash at all, and he doesn't remember telling police he was behind the wheel.

Kathy Ray, prosecutor, said, "You heard yourself on that tape: 'I remember hitting the brakes and, err, that's all I remember.’ Did you hear that?"

“Yes, ma'am, did hear that."

"And that's what happened, isn't it?"

"I cannot tell you."

Schmalz further explained due to a head injury and potent medication he doesn't remember talking to the victim's brother at the mall a few weeks later either.

Searg Davidian, the victim's brother, said, "I didn't know what to say to him, if I should say he killed my brother or not."

Keith Schmalz faces 15 years or more in prison if the jury decides he was drunk and in the driver's seat the night Sevag Davidian was killed.

The verdict of guilty came in Friday afternoon with one count of DUI manslaughter, one count of DUI causing serious bodily injury, and eight counts of DUI causing damage to person or property.
