The man caught on tape being beaten by the New Orleans police headed to court Wednesday.
Robert Davis has been charged with public intoxication, resisting arrest, battery on a police officer and public intimidation.
Davis says he was in the French quarter when two officers hit him and threw him to the pavement.
The retired school teacher insists he wasn't drunk and that he was never tested for drunkenness after his arrest.
He has pleaded not guilty to all charges.
