The City of Tallahassee says a lawsuit filed against its Inclusionary Housing Ordinance has no merit and is asking a judge to dismiss the case.
The city is asking a judge to dismiss a lawsuit against its Inclusionary Housing Ordinance brought on by the Home Builders Association and the Board of Realtors.
The ordinance requires 10 percent of new developments with more than 50 homes to include work-force housing. The Home Builders Association contends that law is unconstitutional.
City attorney Jim English is standing by his belief that the suit has no merit.
A hearing is expected sometime in the next 20 to 30 days.
