We could be looking at round two in the Kappa hazing case.

Florida assistant state attorney Frank Allman told Eyewitness News this week he doesn't see any reason why this case should not proceed.

On October 9 the case against five Kappa Alpha Psi fraternity brothers ended in a mistrial.

The fraternity brothers were charged with using canes, boxing gloves and bare fists to beat aspiring fraternity member Marcus Jones.

A verdict would have been the first test of a new state law that makes hazing a felony if it results in death or serious bodily injury.

A new trial date will be set during a status hearing on Monday, August 16 at 9:00 a.m.
