Twenty-six-year-old Shaun Washington was found not guilty on five DUI counts, but guilty on five counts of negligence.
Assistant state attorney Shirley Bates said she is not pleased with the outcome of this verdict.
Washington received a sentence of only 280 days behind bars for allegedly driving
drunk with a carload of children back on April 12.
Jurors felt the state did not show enough evidence to prove Washington was driving drunk that night in April, causing the injury of five young passengers.
"I am a little disappointed. I think that when an adult has children in his car he is responsible for the control of that vehicle," said Bates.
