A man on death row for one of Tallahassee's most notorious murders is back in court trying to get his death sentence thrown out.
Joe Elton Nixon was in a Leon County courtroom Monday morning hoping to be declared mentally retarded. That would prevent the state from executing him.
Nixon was sentenced to die for the 1984 murder of Jeanie Bickner. She was kidnapped from Governor's Square Mall, tied between two trees and set on fire.
Monday's court hearing wrapped up late in the afternoon. Judge Jonathon Sjostrom says it will be at least 60 days before he issues a ruling.
