Cell phone video just released by the state attorney's office shows a Florida trooper shouting for help in the wake of struggle over his gun.
A bystander at Seminole Grand apartments took the video on his or her phone on May 8th.
It shows trooper Dennis Gallo firmly in the grip of a man next to his patrol car.
There is glass on the ground nearby presumably from a shot fired in the struggle and a woman standing just feet away dialing 911.
Court records show Sherlin Herard is still in jail. He's being held without bond on charges of aggravated assault, aggravated stalking and battery with great bodily harm.
An FHP spokesperson says Trooper Gallo just returned to full duty on Friday, May 23rd.

Tallahassee, FL - An off-duty Florida Highway Patrol Trooper was injured in a fight with a man at the Seminole Grand apartment complex around 6:30 Thursday evening.
FHP Trooper Dennis Gallo, who lives at Seminole Grand, reported that he started noticing post-it notes left on his patrol vehicle with obscene messages over the last week. More messages were left on his vehicle Thursday.
As Gallo walked to his patrol vehicle later in the day, he found 22-year-old Sherlin Herard sitting on the hood with a drink and a laptop, arrest papers said. When asked if he was the one who left the notes, Herard admitted to doing it and walked away. as Gallo entered his vehicle.
A short time later, Herard came back to the vehicle and jumped on top of the hood saying "come move me" and "make me get off." Gallo then requested help from FHP dispatch.
According to arrest papers, Herard jumped off the vehicle and the two began fighting. According to arrest papers, Gallo fell to the ground while Herard stood over him and punched him in the face and stomach area.
While down on the ground, Gallo's off-duty concealed gun came loose and fell to the ground. Both Gallo and Herard grabbed the gun. Arrest papers say the gun fired into the open drivers side door of the vehicle shattering the side window. The two men continued to fight over the gun until Tallahassee Police Department officers arrived on scene and arrested Herard.
Gallo suffered minor cuts to his face, hands and arms, along with a swollen face from multiple punches. Gallo was transported to Tallahassee Memorial Hospital for treatment.
Herard is charged with aggravated assault with a deadly weapon, aggravated stalking and battery causing bodily harm. TPD says Herard suffers from a mental illness and had been placed in protective custody twice in April 2014.
