With the Democratic candidates still scouring the states for delegates, who will win is not a sure thing. In Michigan, the winner still hangs in the balance.

Jeffrey Toobin, a CNN Senior Legal Analyst weighed in on the issues during his stop in Tallahassee Thursday. He said, "If they're split fifty-fifty, that's good for Obama. Clinton needs to have the old primary count or to have a new one and that's a harder sell because the first one was against the rules and the second one costs a lot of money."

But why does Florida always seem to grab the election spotlight? Now, having dealt with a delegate debacle, as well as the infamous hanging chads from 8 years ago. Toobin said, "This is a state with short political traditions where there isn't an established date for a primary, so they felt comfortable trying to move it around, but they played chicken with the Democratic National Committee and lost. And now it's really Hillary Clinton trying to get those delegates back up on the board."

John McCain, well on his way for the general election, seems not to have as many obstacles. We asked how this delegate squabble affect him? "This is a tremendously motivated democratic party with very high turnout in the primaries, raising unprecedented amounts of money, getting a great deal of attention. McCain has none of those things going for him." Toobin said.

When the Democratic National Convention rolls around, Toobin feels if there is unity in the party, that excitement will work in their favor, regardless of which candidate steps up to the podium.
