Deferred Compensation Challenged

A candidate for Tallahassee commissioner is now saying that the commission's deferred compensation plan is not legal.
Erwin Jackson is accusing the city commission of making an illegal decision four years ago when it approved a deferred compensation benefit.
The 22-thousand dollar benefit was extended to several top city employees as well as to the commissioners.
But the city attorney says he fully investigated the issue before it was approved.
"We've never seen any challenge nor have I seen one statewide, I mean it's... cities have the right under home rule to set the salaries of their officials," says Jim English, the city attorney for Tallahassee.
The deferred compensation becomes available to commissioners when they retire from working. If they want to access the funds before retiring, they will have to pay a penalty.
